1. Definitions
In these Terms and Conditions:
- "Lumivest," "we," "us," "our" refers to Lumivest, based in Kuala Lumpur, Malaysia.
- "User," "you," "your" refers to any individual accessing our website or enrolled in a programme.
- "Programme" refers to any of Lumivest's educational offerings: the Investing Concepts for Beginners course, the Foundations of Investing Workshop, or the Comprehensive Investing Literacy Program.
- "Content" refers to all materials, text, concept maps, worksheets, reading library resources, and other educational material provided by Lumivest.
- "Agreement" refers to these Terms and Conditions, along with our Privacy Policy and Cookie Policy.
2. Acceptance of Terms
By submitting an enquiry form, enrolling in a programme, or accessing any part of our website, you confirm that:
- You are at least 18 years of age;
- You have the legal capacity to enter into a binding agreement under Malaysian law;
- You have read and agree to be bound by these Terms and Conditions.
3. Description of Services
Lumivest provides general, conceptual education about investing ideas through structured programmes. All content is for educational purposes only and does not constitute financial, investment, or legal advice. Lumivest does not hold a Capital Markets Services Licence and does not operate as a regulated financial advisory entity under Malaysian law.
Our programmes are available to participants based in Malaysia. Access outside Malaysia is not actively restricted but is at the user's own discretion and does not entitle the user to any additional rights or services.
4. User Accounts
Upon successful enrolment, you will receive programme access credentials. You are responsible for keeping these credentials confidential and for all activity carried out through your account. You must notify us promptly at [email protected] if you suspect unauthorised access to your account.
5. User Responsibilities
You agree to use Lumivest programmes and website only for lawful purposes and in a manner consistent with these Terms. You must not:
- Share programme access credentials with third parties;
- Reproduce, distribute, or republish programme Content without written permission;
- Use the website in a manner that could damage, disable, or impair its functionality;
- Submit false or misleading information through our contact or enrolment forms;
- Use any automated means to access or scrape website content.
6. Intellectual Property
All Content provided through Lumivest programmes, including but not limited to course modules, concept maps, worksheets, terms indexes, and reading library curation, is the intellectual property of Lumivest and is protected under applicable Malaysian intellectual property law.
Upon enrolment, you are granted a limited, non-exclusive, non-transferable licence to access and use the Content for your personal educational purposes only. You may not reproduce, share, sell, or modify the Content without prior written consent from Lumivest.
7. Fees and Payment
Programme fees are as follows (in Malaysian Ringgit):
- Investing Concepts for Beginners: RM 510
- Foundations of Investing Workshop: RM 1,720
- Comprehensive Investing Literacy Program: RM 2,860
All fees are stated inclusive of applicable taxes. Payment methods and bank details are communicated upon confirmation of your enquiry and enrolment. Fees are due in full before programme access is granted.
Refund Policy: If you request a cancellation more than 7 calendar days before your programme start date, we will issue a refund of the fee paid, less any administrative processing costs. Cancellations made within 7 days of the start date, or after the programme has commenced, are not eligible for a refund. In the case of programme cancellation by Lumivest, a full refund will be issued.
8. Programme-Specific Terms
The following apply to educational programme enrolment:
- Programme content is for the enrolled participant only and must not be redistributed or shared;
- Lumivest reserves the right to modify programme schedules, session timing, or content with reasonable advance notice to participants;
- Completion of a programme does not confer a professional qualification, licence, or regulated certification of any kind;
- Participants are expected to engage respectfully in any group or live discussion elements.
9. Disclaimers
Lumivest programmes are provided strictly for general educational purposes. All Content is provided "as is." We make no representation or assurance that:
- Any investment decisions made following participation in a programme will achieve any particular outcome;
- The Content constitutes professional financial, investment, or legal advice;
- The website will be continuously available or free from errors at all times.
Participants should consult a licensed financial adviser before making any investment or financial decisions.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Lumivest shall not be liable for any indirect, incidental, or consequential loss arising from your use of our programmes or website. Our total liability to you in respect of any claim shall not exceed the programme fee paid by you for the relevant programme.
Lumivest is not responsible for losses arising from: reliance on programme Content for financial decision-making; technical failures outside our control; or circumstances constituting force majeure.
11. Indemnification
You agree to indemnify and hold harmless Lumivest, its employees, facilitators, and partners from and against any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms or your misuse of our programmes or website.
12. Termination
Lumivest reserves the right to suspend or terminate your access to any programme if you breach these Terms, including through misuse of Content, sharing of credentials, or disruptive conduct in group settings. In such cases, no refund will be issued for the unused portion of the programme.
You may request cancellation of your enrolment in writing to [email protected], subject to the refund policy in Section 7.
13. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under or in connection with these Terms shall first be subject to good-faith informal resolution between the parties. If unresolved within 30 days, disputes shall be referred to the courts of Malaysia, with the courts of Kuala Lumpur having jurisdiction.
14. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Lumivest regarding use of our services.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
- No Waiver: Failure by Lumivest to enforce any provision does not constitute a waiver of the right to enforce it in the future.
- Assignment: Lumivest may assign its rights under these Terms without your consent. You may not assign your rights without our prior written approval.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of our website or participation in our programmes after changes are posted constitutes acceptance of the updated Terms. For enrolled participants, we will provide reasonable notice of material changes by email.
